In re Rivera v. Deutsche Bank National Trust Company as Trustee, et al. Case Number NCA-13-1615-KuPaJu (unpublished), Ron appeared before the 9th Circuit Bankruptcy Appellate Panel (“BAP”) and argued that in bankruptcy, a debtor has the right to challenge the secured status of a party claiming to be a creditors in the bankruptcy.  The BAP agreed and remanded the matter back to the trial court for litigation.

Butler v. Wells Fargo Bank, N.A. , Case Number G050260 the California Court of Appeals agreed that Butler had “two strings to his bow” focusing on the improper charges made to Butler’s account, which were then used as a pretext to foreclose.  The matter was affirmed except the issue of wrongful foreclosure which was remanded back to the trial court for litigation.

Mr. Freshman has successfully negotiated settlements, and continues to fight for homeowners against wrongful foreclosure, unlawful detainer, and predatory servicing of loans. If you need assistance, please give Ron a call to determine if the Freshman Law legal team can assist you.
